Abstract

One of the most important aspects of electronic transactions is that there must always be "dispatch" of intentions via electronic media. Therefore, consideration whether the electronic information has been "dispatch" is consideration whether intentions have been expressed. According to Section 22 of the Electronic Transactions Act, BE 2544, which was drafted in accordance with the UNCITRAL Model Law on Electronic Commerce 1996, the information is considered “dispatch” when it has entered into an information system beyond the control of originators. This provision, however, may not be applied to the dispatch of information that originators and recipients exchange information on the same information system. Since the information will never enter into the information system that is beyond the control of the originators, the intentions will never be considered expressed, which will also affect the occurrence of electronic contracts. Therefore, the author studied how South Korea and Australia amended their electronic commerce laws, which originally were drafted in accordance with the Model Law as same as Thailand’s, to use as a guideline for amending the Electronic Transactions Act B.E. 2544 of Thailand.
